1. Introduction

TowPart is a digital platform operated by Evizz Digital and Auction Vehicle Recovery (“TowPart”, “we”, “us”, or “our”).

TowPart acts solely as a lead generation and connection service. We do not provide towing, recovery, or roadside assistance services ourselves.

2. Our Role

  • TowPart is a lead generation platform that connects customers who need vehicle recovery services with professional recovery drivers.
  • We provide a marketplace where customers can post jobs and subscribed drivers can view and respond to those leads.
  • We do not perform any recovery work, transport vehicles, or enter into any contract with customers for recovery services.
  • The contract for recovery services is formed directly between the customer and the driver. TowPart is not a party to that contract.

3. Driver Responsibilities

By using TowPart as a driver, you agree that:

  • You are an independent business/operator and not an employee, agent, or partner of TowPart.
  • You are fully responsible for all jobs you accept, including the quality, safety, and legality of the service provided.
  • You have the required licenses, insurance, vehicles, and equipment to legally perform vehicle recovery work.
  • You will enter into a direct contractual relationship with the customer for each job.
  • You are solely responsible for pricing, invoicing, payment collection, and any disputes with the customer.
  • You must comply with all applicable laws and regulations.

4. Customer Responsibilities

Customers understand that:

  • They are contracting directly with the chosen recovery driver.
  • TowPart only facilitates the introduction and lead delivery.
  • Any issues, complaints, or disputes regarding the recovery service must be resolved directly with the driver.

5. No Agency or Partnership

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between TowPart and any driver or customer.

6. Subscription and Payments

  • Drivers must maintain an active subscription to view customer contact details and accept jobs.
  • Subscriptions are managed via Stripe.
  • All subscription fees are non-refundable except where required by law.

7. Limitation of Liability

To the fullest extent permitted by law, TowPart shall not be liable for any acts or omissions of drivers or customers. We are not responsible for the quality, timeliness, or outcome of any recovery job.

8. Indemnity

You agree to indemnify and hold TowPart harmless from any claims, damages, or losses arising from your interactions with customers or the services you provide.

9. Governing Law

These Terms and Conditions are governed by the laws of the United Kingdom.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory local law in Scotland or Northern Ireland requires otherwise.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the platform after changes constitutes your acceptance of the new Terms.

By using TowPart, you acknowledge that TowPart is only a lead generation platform and that you form a direct contract with the customer for all recovery services.
